TERMS OF SERVICE & TEAM INFO

1. Team Architecture & Intellectual Property

NetGate is an advanced software solution engineered by NetGet, which operates as a specialized network and infrastructure division under the ultimate ownership of DPLAY-TEAM.

All software code, user interface designs, logos, and communication protocols associated with NetGate remain the exclusive intellectual property of DPLAY-TEAM. Users are granted a revocable, non-transferable, and non-exclusive license to use the application strictly for personal or internal business purposes.

2. Strict Jurisdictional Compliance & Sanctions

NetGate operates its services in strict adherence to international laws and trade embargoes. The User explicitly warrants that they will not deploy, access, or configure NetGate software from strictly prohibited regions.

Zero-Tolerance Policy: Under NO circumstances shall NetGate be utilized within, or for the benefit of entities located within, the Russian Federation or the Democratic People's Republic of Korea (DPRK). Any evasion tactics (including VPN obfuscation or GPS spoofing) to bypass these restrictions will result in immediate and permanent hardware/software bans. No financial compensation or data recovery will be provided.

3. Limitation of Liability for Physical Hardware

NetGate provides a software interface for remote TCP/IP communication. We do not manufacture your physical gate, motor, or local network hardware. Therefore, you agree to the following absolute limitations of liability:

Network Latency & Failures: DPLAY-TEAM and NetGet are not responsible for gate malfunctions caused by ISP latency, local Wi-Fi dropouts, or TCP packet loss.
Property Damage & Injury: You are strictly responsible for visually ensuring the gate's path is clear before issuing remote "Close" or "Proportional Open" commands. We disclaim all liability for any physical injury, vehicular damage, or property destruction resulting from the use of this application.
Safety Mode Reliance: While our GPS "Safety Mode" provides an additional layer of security, it relies on your iPhone's hardware GPS accuracy. It is a secondary safety mechanism and must not replace human situational awareness.

4. Acceptable Use & Termination

You agree not to reverse engineer the NetGate app, attempt to extract the source code, or use the application to intercept/sniff unauthorized network traffic. DPLAY-TEAM reserves the right to terminate your license and block access to our configuration servers at our sole discretion if we detect malicious activity, abuse of the QR code sharing system, or violation of these Terms.
